1. Scope & provider. These General Terms & Conditions apply to all coaching programmes, breathwork sessions, and events offered by Andreea Simon (Breathwork & Coaching by Andie Simon, Ortsstr. 15, 78357 Mühlingen) as provider. The services offered at www.andie-simon.com are directed exclusively at participants who have reached the age of 18. All services and offers are provided exclusively on the basis of these General Terms & Conditions. These also apply to all future business relationships, even if not explicitly agreed upon again.

2. Participation conditions. Participation in coaching programmes, breathwork sessions, and events is voluntary. Each participant bears full responsibility for their own actions. For certain physical and psychological conditions, participation is inadvisable. The provider therefore reserves the right at any time to advise against or decline participation. Any chronic or acute health conditions must be disclosed before the programme begins. By registering, you confirm that you are psychologically and physically stable and able to participate without risk to your own health or the health of others. Important: Participation in these programmes does not replace therapeutic or conventional medical treatment and is undertaken at your own responsibility.

3. Conclusion of contract. The contract becomes binding upon the written confirmation of registration sent by the provider. The invoice for the participation fee is included with the registration confirmation. Registration constitutes acceptance of these terms and authorises the sending of further programme-relevant information to the email address provided during registration.

4. Payment terms. The participation fee is due within 14 days of receiving the invoice, unless otherwise agreed. Instalment payment is available by arrangement.

5. Liability. Participation in these programmes is at your own responsibility. You are responsible for listening to your body and respecting your limits. The provider is not liable for health impairments resulting from the application of the techniques taught, provided these are not attributable to gross negligence or intentional misconduct on the part of the provider. For in-person events, no liability is assumed for personal belongings brought along.

6. Data protection. Your personal data is stored for the purpose of fulfilling and processing the contract and handling enquiries. The provider adheres to the principles of data avoidance and data minimisation. After the respective purpose ceases to apply, data is routinely deleted in accordance with statutory provisions. 7. Cancellation of an event. Should a programme be unable to take place due to illness or other reasons beyond the provider's control, it will be rescheduled or the participation fee already paid will be refunded in full. No claim for damages may be made due to a cancellation.

8. Rescheduling. If a scheduled session cannot be attended for reasons attributable to the participant, the provider will endeavour to find an alternative date. There is, however, no entitlement to this. Rescheduling requests should be communicated at least 24 hours in advance.

9. Health practice disclaimer. These programmes serve the purposes of prevention, guidance, support, and accompaniment. They do not replace visits to doctors, naturopaths, or psychotherapists and make no healing promises.

10. Final provisions. Should one or more provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected. Contracts between the participant and the provider are exclusively subject to German law.

Your right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.

To meet the withdrawal deadline, it is sufficient that you send the communication before the deadline expires.

Consequences of withdrawal. In the event of withdrawal, all payments received will be refunded without undue delay and no later than fourteen days, using the same means of payment as the original transaction. If you have requested that the service begin during the withdrawal period, you shall pay a reasonable amount corresponding to the proportion of services already provided.

Early expiration — services. The right of withdrawal expires prematurely when the provider has fully performed the service and began performance only after obtaining your express consent and your acknowledgement that you lose your right of withdrawal upon complete fulfilment of the contract.

Early expiration — digital content. The right of withdrawal expires for contracts concerning the supply of digital content not on a physical medium (e.g. downloads, online materials, recordings) when the provider has begun performance after obtaining your express consent and acknowledgement that you thereby lose your right of withdrawal.

Withdrawal form. To withdraw, send a clear statement to the address above including: your name, the programme booked, booking date, and the statement that you wish to withdraw. A template is available upon request.

As part of UNBREATHE, you will be working with a powerful breathing technique (Psychedelic Breath® & Conscious Connected Breath) that affects your physical, emotional, and mental state. A stable psychological condition and the absence of certain physical contraindications are therefore required.

Contraindications

Participation in UNBREATHE and the breathwork sessions it contains is not suitable if any of the following conditions apply to you:

— Cardiovascular disease

— Severe high blood pressure

— Diagnosed psychiatric disorders

— Epilepsy

— Recent surgery and/or bone fractures

— Current contagious infections

— Glaucoma

— Other eye conditions

— Pregnancy
